2. Definitions

For purposes of these Terms:

• "Services" refers to all modeling agency services, including representation, portfolio development, and career management
• "Model" refers to any individual seeking or receiving representation from the Agency
• "Client" refers to brands, companies, or individuals booking modeling services through the Agency

• "Content" refers to all text, images, videos, and other materials on our website

3. Eligibility and Registration

3.1 Age Requirements

• You must be at least 16 years old to apply for modeling representation
• Applicants aged 16-18 require parental or guardian consent
• Legal guardians must approve all contracts and activities for minors

3.2 Application Process

• All information provided must be accurate and truthful
• False or misleading information may result in immediate disqualification
• We reserve the right to verify all submitted information
• Application does not guarantee representation

3.3 Account Security

• You are responsible for maintaining account confidentiality
• Notify us immediately of any unauthorized access
• You are liable for all activities under your account

4. Agency Services

4.1 Scope of Services

Our services include, but are not limited to:

• Model representation and career management
• Portfolio development and guidance
• Booking coordination and negotiation
• Industry networking and connections
• Professional development and training referrals
• Marketing and promotion of represented models

4.2 No Guarantee of Work

We do not guarantee:

• Specific number of bookings or income levels
• Particular types of modeling assignments
• Success in the modeling industry
• Acceptance of applications for representation

4.3 Representation Agreement

• Representation requires a separate written agreement
• Terms of representation will be specified in individual contracts
• Either party may terminate representation as specified in the agreement

5. Fees and Payment

5.1 Commission Structure

• The Agency receives commission on bookings as specified in representation agreements
• Commission rates will be clearly stated in individual contracts
• Payment terms will be outlined in booking confirmations

5.2 Additional Fees

• Additional fees for specific services will be disclosed in advance
• All fees are subject to applicable taxes
• Payment terms vary by service type

5.3 No Upfront Fees

Golden Dream Escape does not charge upfront fees for representation consideration. Beware of scams requesting payment before representation.

6. Intellectual Property Rights

6.1 Agency Content

• All website content is owned by Golden Dream Escape or licensed to us
• You may not reproduce, distribute, or modify our content without permission
• Our trademarks and logos are protected intellectual property

6.2 User-Submitted Content

• You retain ownership of content you submit (photos, videos, etc.)
• You grant us license to use submitted content for representation purposes
• You represent that you have rights to all submitted content
• You will not submit content that infringes third-party rights

6.3 Portfolio and Promotional Materials

• We may create and use promotional materials featuring represented models
• Models grant permission for use of their likeness in agency marketing
• Specific usage rights will be detailed in representation agreements

7. User Conduct and Prohibited Activities

You agree not to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Submit false or misleading information
• Harass, abuse, or harm other users
• Distribute spam or unsolicited communications
• Attempt to gain unauthorized access to our systems
• Use our services for illegal or unauthorized purposes
• Interfere with or disrupt our services
• Impersonate any person or entity
• Collect user information without consent

8. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy. We collect, use, and protect your personal information as described in our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of content

9.2 Limitation of Liability

To the maximum extent permitted by law, Golden Dream Escape shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or data
• Business interruption
• Personal injury or property damage

9.3 Maximum Liability

Our total liability shall not exceed the amount of fees paid to us in the six months preceding the claim.

You agree to indemnify and hold harmless Golden Dream Escape, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of any rights of third parties
• Your use of our services

11. Termination

11.1 Termination by Agency

We reserve the right to suspend or terminate your access to our services at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Behavior harmful to our business or reputation
• Any reason at our sole discretion

11.2 Effect of Termination

• Your right to use our services immediately ceases
• We may delete your account and content
• Provisions that should survive termination will remain in effect
